End-User License Agreement (EULA)

This End-User License Agreement ("Agreement" or "EULA") is a legally binding contract between you (either an individual or a single legal entity, referred to as "Licensee," "you," or "your") and PROTEKKT SOFTWARE d.o.o., a company incorporated under the laws of the Republic of Croatia, registered with the court registry of the Commercial Court under MBS: 081707259, OIB: 28968924128, having its registered office at Lomošćanska cesta 34D, 47300 Ogulin, Croatia ("Licensor," "we," "us," or "our").

By downloading, installing, copying, accessing, or otherwise using the Licensor’s local obfuscation software application, Command Line Interface (CLI) tools, plugins, or graphical user interfaces (collectively, the "Software"), you agree to be bound by the terms of this Agreement. If you do not agree to these terms, do not install, download, or use the Software.

1. DEFINITIONS

  • "Software" means the locally installed obfuscator client executable, CLI tools, libraries, files, and any updates or documentation provided by Licensor.
  • "Service" means the remote, cloud-based application infrastructure operated by Licensor that processes metadata or structural blueprints sent by the Software.
  • "Licensee Code" means the source code, intermediate bytecode, or binary files owned or managed by the Licensee that are processed using the Software.

2. LICENSE GRANT, TERM, AND SINGLE-PUBLISHER LIMITATION

  • Annual Term: Subject to your strict compliance with this Agreement and timely payment of all applicable fees, Licensor grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to install and execute the Software on machines owned or controlled by you solely for the purpose of protecting applications published, distributed, and branded exclusively under your own legal entity or corporate identity. This license is granted for a fixed term of exactly one (1) year (365 days) from the date of license activation ("License Term").
  • Single-Publisher Restriction: You are expressly prohibited from utilizing the Software as an outsourced agency, contractor, service bureau, or technical intermediary to apply obfuscation or license protection layers to software code or assets owned, published, or sold by third-party clients or external entities. The ultimate intellectual property holder of the protected assets must secure an independent product license directly from the Licensor.
  • Survival of Protected Binaries: Upon the expiration or non-renewal of your 1-year License Term, your right to execute the Software to generate new obfuscated builds terminates immediately. However, you retain a perpetual, fully paid-up, royalty-free right to continue distributing, running, and maintaining any specific binaries or software files that were successfully protected by the Software prior to the official expiration date of your license. The 365-day operational restriction applies solely to new compilation processes and does not retroactively impact previously finalized, validly watermarked output files.

3. COMPREHENSIVE COMPETITIVE EXCLUSION

  • Prohibition of Competitive Evaluation and Use: You explicitly warrant and represent that you are not an employee, contractor, advisor, owner, or affiliate of any business entity that builds, markets, or maintains commercial software obfuscators, control-flow virtualization platforms, code-tampering protections, license validation tools, or anti-cracking software utilities ("Competing Enterprises").
  • Prohibition of Competing Product Protection: You are strictly forbidden from executing the Software to protect, structure, or pack any software utility or product module that functions as an obfuscator, code protection library, or DRM framework. You shall not utilize the Software for competitive benchmark evaluation, feature parity analysis, or reverse engineering of Licensor's internal translation methodologies.
  • Permitted Gaming and Anti-Cheat Clarification: For the avoidance of doubt, this restriction does not prohibit video game publishers, digital content providers, or independent anti-cheat software vendors from utilizing the Software to protect retail entertainment applications or cheating-countermeasure engines. These use cases are fully permitted provided that the primary commercial purpose of the application being protected is interactive entertainment or memory-integrity telemetry, and not the standalone distribution of software obfuscation or license enforcement utility tools.

4. AUTOMATIC EXPIRATION AND REMOTE SERVICE DEPENDENCY

  • API Dependency: Licensee acknowledges and agrees that the Software cannot operate standalone and requires a continuous, authorized internet network connection to Licensor’s remote infrastructure to perform its primary obfuscation functions.
  • The 365-Day Kill Switch: Upon the expiration of your 1-year License Term, our remote infrastructure will automatically reject data transmissions from your installation of the Software. This will render the local Software completely inert and incapable of performing further obfuscation operations until a manual renewal is processed.

5. RESTRICTIONS AND PROHIBITED USES

You shall not, and shall not permit any third party to:

  • Reverse Engineer: Decompile, disassemble, reverse engineer, decrypt, or attempt to derive, reconstruct, or discover the source code, underlying algorithms, network protocols, or structural logic of the local Software binary or its communications with the remote Service.
  • Bypass Security: Circumvent, disable, or defeat any copy protection, licensing validation mechanism, or structural security features built into the Software.
  • Prohibited Loop Activity: Wrap, embed, or script the Software inside an infinite loop, continuous automated polling cycle, or high-frequency repetition sequence. Execution of the Software must be triggered solely by discrete development events (such as manual command triggers or standard CI/CD pipeline commits).
  • Redistribute and Embedded Licensing: Rent, lease, lend, sell, sublicense, assign, distribute, or transfer the Software binary and its accompanying files to any third party. Licensee acknowledges that a unique, cryptographically bound license identifier is embedded directly within the delivered Software binaries. Any unauthorized distribution, mirroring, or public exposure of these binaries constitutes a material breach that will result in the immediate, automatic termination of your subscription, the permanent revocation of your license key, and the total forfeiture of all paid fees without any right to a refund.

6. COMPLIANCE WITH ONLINE TERMS AND ANTI-MALWARE POLICY

Your right to use the Software is strictly contingent upon your compliance with our online Terms of Use, which are incorporated herein by reference and accessible at https://protekkt.io. Under those terms, you are absolutely prohibited from utilizing the Software to protect or obfuscate applications containing malware, ransomware, or any illegal payloads. If Licensor determines that the Software is being utilized under your license to protect malicious applications, your local license shall be instantly and automatically revoked without notice, your remote access will be terminated, and you shall forfeit all fees paid.

7. LOCAL PROCESSING BOUNDARIES AND REMOTE LICENSING PRIMITIVES

  • Exclusive Local Application Analysis: The structural analysis, control-flow mapping, and comprehensive obfuscation of your User Code are performed on your machines. Unprotected binaries are never transmitted or exposed to our remote servers.
  • Agnostic Data Generation and Integration: To enforce your 1-year license validity, the local Software queries our remote infrastructure using generic, isolated structural tokens (such as basic operator identifiers). In response, our server generates and returns abstract, synthetic algorithmic implementations, mathematical primitives, or layout schemas ("Licensing Data"). The local Software embeds this Licensing Data into the final output binary to complete assembly. The Software cannot finalize a protected file without retrieving these independent, server-generated functional components.

8. BINARY WATERMARKING AND DETECTION DISCLOSURES

  • Watermark Injection: You acknowledge and agree that the Software injects a unique, non-functional, cryptographically randomized digital signature ("Watermark") into every output binary or script it protects. This Watermark is specific to your license key and distinct customer identity, allowing the Company to mathematically identify which license was used to protect a given application.
  • Default Signature Confidentiality: The Licensor actively protects the operational privacy of our customers and does not publicly share or distribute the unique file signatures, cryptographic patterns, or structural indicators of applications safely protected under our licenses.
  • Conditional Disclosure for Malware Mitigation: In the express event that any protected binary carrying a Watermark assigned to your license is verified by the Company to contain a Malicious Payload (in violation of Section 5), the Company reserves the unilateral right, without prior notice or liability, to instantly create, distribute, and make entirely public any "detection rules," YARA rules, file hashes, structural patterns, or cryptographic signatures required to identify, detect, and intercept any and all files protected under your license key. This defensive footprint data may be delivered directly to automated cybersecurity vendors, operating system developers, anti-virus repositories, and global threat intelligence platforms to systematically flag and neutralize all outputs generated under the non-compliant subscription.

9. NO WARRANTY ("AS IS")

THE SOFTWARE IS PROVIDED TO LICENSEE "AS IS" AND WITH ALL FAULTS AND DEFECTS WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE CROATIAN LAW, LICENSOR EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. LICENSOR MAKES NO WARRANTY THAT THE OBFUSCATED OUTPUT CODE WILL BE ERROR-FREE, COMPATIBLE WITH EVERY FUTURE RUNTIME ENVIRONMENT, UNBREAKABLE BY MALICIOUS THIRD PARTIES, OR THAT THE OBFUSCATION PROCESS WILL NOT INADVERTENTLY ALTER THE PERFORMANCE OR RUNTIME BEHAVIOR OF THE LICENSEE CODE.

10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY THE CROATIAN CIVIL OBLIGATIONS ACT, IN NO EVENT SHALL LICENSOR BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, BUILD PIPELINE FREEZES, OR RUNTIME APP CRASHES ARISING OUT OF OR IN ANY WAY RELATED TO THE USE OF OR INABILITY TO USE THE SOFTWARE), EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY OF LICENSOR UNDER ANY PROVISION OF THIS AGREEMENT EXCEED THE ACTUAL AMOUNT PAID BY LICENSEE TO LICENSOR FOR THE SOFTWARE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. GOVERNING LAW AND JURISDICTION

This Agreement shall be governed by and construed in accordance with the laws of the Republic of Croatia, without giving effect to any choice of law principles. Any legal action or proceeding arising under this Agreement shall be brought exclusively before the competent court in Croatia, specifically the Commercial Court in Zagreb (Trgovački sud u Zagrebu), and the parties hereby consent to personal jurisdiction and venue therein.

12. TERMINATION

This Agreement and your license automatically terminate on Day 365 of your term, or immediately without notice if you fail to comply with any restrictive covenant or acceptable use rule outlined in this EULA or the online Terms of Use. Upon termination, you must cease all use of the Software and destroy all copies of the Software in your possession.
